INDUSTRIAL DESIGN: if AI made the design, do you even own it?
——— Teams now use AI to generate concepts, renderings, even CAD. It feels fast and good enough for now. But do you really own it?
In the U.S., copyright depends on human authorship. If the final design comes from a prompt, you likely have no copyright at all. A competitor can take that exact rendering, that packaging, the design you paid for, and use it. You have nothing to stop them with.
Trademark can still protect your name and your logo as identifiers in your market. It does not extend to the designs themselves.
This doesn’t mean avoiding AI altogether. Just make sure a human is clearly shaping the result through real design process and decisions you can point to.
Not only does this make your design more ownable. It makes it more reliable.
